@cp24breakingnews: Criminal defence lawyer Kim Schofield joins CP24 to break down what Canadians can and cannot legally do to defend themselves, their family, and their property during a home invasion. #breakingnews #watch #newstiktok #canada
in other words, the moment the suspects start to flee the scene you must disengage your defense. do not pursue the suspects.

To answer the burning question everyone wants the answer to: Legally, in Canada, if they brandish a firearm, you may use a firearm to defend yourself. You cannot use a firearm if they are not armed with and brandishing their firearms. If they flee or strictly go for property, you cannot use any harmful deterrence. You can never shoot at someone in the back or while they flee.

Use of force plus one. You can do what you deem necessary to stop the threat. Once the threat no longer exists and cannot continue to exercise continued force as that would be considered excessive.

But you’ll be charged first and spend all your money to make a defense, go to court and live with uncertainty for 5 years

Basically if they come at you with a deadly weapon, your life is at risk you can use deadly force

basically, the police will lay a charge against the defender and let the judge figure out what's "reasonable."

translation: 1) you can use whatever force seems necessary in self defense if someone breaks into your house and you feel threatened for yourself or family.2) the physical house doesn't count, only occupants you believe are there 3) you're not reasonably expected to reassess if the threat is no longer a threat once you've started to defend yourself. examples in reply...

incorrect! you are not permitted to use any force beyond what the attackers offer.
eg: using a stick in a fist fight is illegal. shooting someone for punching you is illegal!
did you take law? I did.

the law basically says if you get punched and you throw back two! your response was not measured and excesseive and as such, you now need to pay damages to the person who broke into your house.

Threshold should be, do you fear your life? did they have deadly weapon? the law should be simple you shouldn't be thinking too much or be required to study the law to defend yourself.
