Three Vietnam War veterans and a retired architectural historian are asking a federal court to halt the Trump administration’s proposed 250-foot—approximately 76-meter—arch at Memorial Circle, between Arlington National Cemetery and the Lincoln Memorial. The plaintiffs argue that the administration has not obtained the congressional authorization required for construction and that the structure would obstruct a historically significant sightline between Arlington House and the Lincoln Memorial. They want construction paused before the project becomes a fait accompli while its legality remains unresolved. These are the plaintiffs’ legal arguments, not findings that the court has already made. One plaintiff, Navy veteran Shaun Byrnes, served two tours in Vietnam. He told CBS that his opposition reflects a duty to comrades who did not return and to those buried at Arlington. Jon Gundersen, a former Army Special Forces officer, described the lawsuit as an act of loyalty to the country rather than a partisan effort. The Justice Department is seeking dismissal, arguing that the plaintiffs’ objections to the project’s aesthetics and symbolism do not establish a concrete injury sufficient for legal standing. The administration also submitted sworn declarations from Defense Secretary Pete Hegseth and Homeland Security Secretary Markwayne Mullin, arguing that the arch could help the military and Secret Service counter drones and other threats. Government attorneys said the first six months would involve underground and foundation work that would not immediately obstruct the disputed views. According to Justice Department filings, construction could begin as early as November 5 if the National Capital Planning Commission grants final approval that day. That is a conditional schedule—not confirmation that construction will begin or that the court has approved the project.
