When a provider notes clinical evaluations or physical exams they never performed, they breach state medical board standards of professional conduct and compromise patient safety. If these fabricated exam elements are used to justify higher Evaluation and Management (E&M) billing tiers to insurance or Medicaid/Medicare, the conduct constitutes federal Health Care Fraud (18 U.S.C. § 1347) and violates the False Claims Act (31 U.S.C. § 3729).
