My understanding of Reddington’s argument is that the judge errored by declaring a mistrial and prevented a decision for being made therefore they shouldn’t get a second bite at the Apple so to speak and that is why it would be double jeopardy

that is true about double Jeopardy however, his argument rests on the first trial should never have been in this trial because of the prejudice. from the holdout juror. Redington is arguing that he should have been replaced with an alternate because he was refusing to follow the reasonable doubt rules for voting and if he had have been replaced, that trial wouldn't have ended in a mistrial. And that's where double Jeopardy comes in because you wouldn't be able to try her again. it's all interconnected

I think Big Red knows that this isn’t a standard double jeopardy situation… but he’s out here literally doing anything he can to stop the second trial from moving forward fully knowing it’s going against the court of the law.
