@sarahandthe5: Lindsay Clancy returns to court as defense seeks to block retrial in murder case. Judge William Sullivan heard argument about her motion to dismiss, which argues a second trial would be double jeopardy. Clancy's lawyers argue the juror who didn't vote not guilty should have been questioned about what other jurors said was his refusal to follow the law on reasonable doubt. Sullivan has not yet ruled on the motion. Clancy still is charged with three counts of murder for the strangulation deaths of her children, 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan. In court, defense attorney Martin Weinberg argued that the prosecution must prove that the manifest necessity standard was met to warrant a mistrial and, in turn, a retrial. But Weinberg said the defense team believes there first should have been a voir dire, or questioning, of the holdout juror “which could have established further that the reasons were personal, rather than simply because of the internal chemistry of jury deliberations.”
