House Bill 2342 now prevents planned community HOAs from completely banning backyard shade structures such as: • Pergolas • Gazebos • Canopies • Awnings • Umbrellas • Shade sails Your HOA can still create reasonable rules about size, placement and appearance, but it cannot impose a total ban. The law became effective September 12, 2026. (azleg.gov) Senate Bill 1246 also became effective September 12, but it mainly changes the foreclosure threshold for condominium associations. A condo association generally cannot foreclose over unpaid assessments unless the owner is at least $10,000 delinquent or 18 months behind, whichever comes first. The law also adds communication and payment plan requirements before foreclosure. (azleg.gov) Here is the important distinction: Arizona planned community HOAs already received the $10,000 and 18 month foreclosure standard under an earlier law. SB 1246 largely brings condominium associations into the same framework. (nackleylawaz.com) So no, your HOA cannot automatically take your home over a small unpaid balance. But this does not mean you can ignore assessments, local building codes or reasonable HOA rules.
