@occonews: The U.S. Supreme Court on November 2 rejected an emergency request from the Trump administration to require California election officials to segregate mail ballots associated with a list of alleged noncitizens while their citizenship was checked. The Justice Department said federal officials had identified about 20,000 people who appeared on California voter-registration records and whom the government considered likely noncitizens. It argued that once the ballots were processed and mixed with others, they could no longer be separated. The filing emphasized that the requested measure would temporarily segregate ballots rather than cancel them outright. California and local election officials challenged the list’s accuracy and warned that the demand could disenfranchise eligible American citizens. U.S. District Judge David Carter had previously rejected the request, describing the government’s identification process as “rife with uncertainty and errors.” A Ninth Circuit panel subsequently rejected relief in a 2–1 decision. The majority warned that imposing a new segregation process during an ongoing election could disenfranchise voters and jeopardize Los Angeles County’s entire election. Judges Mark Bennett, a Trump appointee, and Gabriel Sanchez, a Biden appointee, formed the majority. Judge Patrick Bumatay, also appointed by Trump, dissented. The Supreme Court denied the emergency injunction in a brief, unsigned order without explanation or noted dissents. California therefore does not have to implement the requested segregation procedure as a result of this application. The decision does not establish the eligibility of every person on the list or constitute a final ruling on the underlying lawsuit.
