When the jury is saying one person won’t follow the instructions, simply asking them if they are willing to follow the instructions and accepting a yes is ridiculous. You do need to understand WHY they are not following them to determine if they CAN follow them. I feel the judge was 100% wrong here as he never took the time to understand the issue the juror may have been having.

Judge Sullivan interpreted the note correctly. “The note indicates that the juror has acknowledged doubt but refuses to apply it. That note does not indicate that the juror refuses to follow the law.” Had the judge singled out the "criminal responsibility" instruction, it could have been interpreted as an attempt to force a specific verdict instead of addressing the single point of failure the jury itself identified as "reasonable doubt".

The entire jury failed to follow the judges instructions and I'm baffled that it isn't being addressed.
