REDDINGTON ATE AND LEFT ABSOLUTELY NO CRUMBS TODAY. LINDSAY CLANCY’S HEARING WAS SOMETHING ELSE. Agree with his arguments or not, THAT is what advocacy looks like. Kevin Reddington walked into that courtroom today ready to fight for his client, and he certainly did not hold back. Today’s hearing addressed several significant legal issues following the mistrial in Lindsay Clancy’s case, including double jeopardy, allegations involving the holdout juror, a proposed gag order, and whether the prosecution intends to retry her. The defense is arguing that the murder charges should be dismissed on double-jeopardy grounds because the judge allegedly declared a mistrial prematurely. The jury was reportedly split 11-1 in favor of finding Clancy not criminally responsible, and the defense maintains that concerns about the lone holdout juror should have been investigated more thoroughly before the jury was discharged. The prosecution disagrees and argues that the mistrial was legally appropriate. Reddington also pushed for further examination of allegations involving the holdout juror, including questions about his jury questionnaire and possible cellphone use. These remain allegations, not established findings of misconduct. Things became heated when Judge Sullivan admonished Reddington for identifying the juror by name in open court. Reddington pushed back, noting that the juror’s identity was already publicly available. But one of the biggest moments came when Reddington demanded clarity from the prosecution. Are they retrying Lindsay Clancy? On first-degree murder? Lesser charges? Or something else? He made clear that his client should not remain incarcerated indefinitely while those decisions are being made. Prosecutors confirmed they intend to retry Clancy if the case proceeds, but have not determined what charges they will pursue. Judge Sullivan suggested March 2027 as a possible retrial date, although nothing has been finalized. Another hearing is scheduled for November 16. And Reddington made something else clear: despite his disagreements with Judge Sullivan, he wants the judge to preside over the next trial before his retirement. Now, here’s the legal reality. A hung jury ordinarily permits a retrial without violating double jeopardy. The defense faces a significant legal hurdle in arguing otherwise. But that does not mean counsel should abandon a constitutional argument they believe has merit. You do not have to believe Lindsay Clancy is innocent. You do not have to agree with Reddington’s arguments. You can even believe the prosecution is entirely justified in pursuing another trial. But you should absolutely respect an attorney who is willing to stand in that courtroom, challenge the prosecution, disagree with the judge, demand answers, and fight for every constitutional protection available to his client. The Constitution does not reserve effective representation for defendants the public likes. It protects everyone. You can disagree with the defense and still recognize damn good lawyering when you see it. And THAT, ladies and gentlemen, is advocacy. #LegallyAtLaw #LindsayClancy #KevinReddington #CriminalDefense #DoubleJeopardy
