If you’re an employment lawyer you should know darn well that HR doesn’t make those decisions. I would put money on those managers who “approved” it for her, turned around and called HR and said “no way.”

This is all a grey area. ADA is vague so it's hard for employers to accommodate. Like how long should they have to accommodate? Unfortunately the world doesn't stop for one person. I work in manufacturing and we have a million people on fmla, we NEED employees to keep the company running!

That two month thing, is a benefit offered by the company, it’s not part of the job itself. If the job she has, requires her to be in the office, then the company isn’t obligated to accommodate her at all, especially if this allows her to be treated differently than any other employee in the company. Nevermind the fact that more often than not, these WFH accommodations, which are only supposed to be temporary, always seem to turn into a longstanding thing, and once it’s been accommodated for at least 6 months, it makes it even more difficult to get the person back to full duty.

HR just represents the executive level leadership. someone in the executive leadership does not want her to be working at home. it has nothing to do with HR specifically. HR is just the enforcement mechanism.

There was a husband and wife at my company who were told by hr that they had to split the 8 weeks of company family leave between them because only one person needed to be home with the baby

Did her doctor put it in writing or was it only verbally recommended? This case is not as cut and dry as you are making it sound. And tbh, the “anxiety” diagnosis because she “can’t” leave her baby is weak. Maybe your client should go on disability if it’s that bad.

But wait.. I was the only HR point of contact at my last company had a baby and was forced back to work because my coverage ended up having her baby early… so who is the real inhumane group? It’s the leadership not the actual HR team

HR isn’t privy to diagnostics. So whatever the reason actually was is not what HR is basing a decision on. They’re basing it on precedent and and policy. Also, HR doesn’t do things to make their own job harder.
