@behnoushshafiei: Refugee Horror Stories: Your Refugee Claim Was Abandoned, but You Never Received Your Hearing Notice What happens if the Immigration and Refugee Board declares your refugee claim abandoned because you missed a hearing you didn't know about? In Canada, refugee claimants are expected to attend their scheduled hearings. However, problems involving hearing notices, incorrect contact information, or communication with a former representative can raise important procedural fairness questions. Under Rule 62 of the Refugee Protection Division Rules, an applicant may request to reopen an abandoned refugee claim where the legal requirements are satisfied. The Board will consider whether there was a failure to observe a principle of natural justice. Evidence concerning how the hearing notice was served, when the claimant became aware of the decision, and the circumstances surrounding the missed hearing may be important. Remember: An abandoned refugee claim is a serious matter, and reopening is not automatic. Taking prompt action and understanding the applicable legal test are essential.
