DHS says it will review voting logs after the election to check whether any noncitizens voted, a move that could collide with state control over voter data. Homeland Security Secretary Markwayne Mullin said in a TV interview that DHS would gather “all the data” and review “voting logs” after the election to make sure that only people legally allowed to vote actually voted. He also said DHS would look at voter registers and “all those that voted after the election.” Mullin did not explain how the department would obtain that information, or what legal tools it might use to access records controlled by states. Noncitizen voting in federal elections is already a federal crime. At the same time, voting administration is largely handled by states, and laws on voter data access vary widely. In many places, whether someone voted is public information, but sensitive personal details, such as Social Security numbers, are not. The Trump administration has previously pressed states to hand over unredacted voter rolls. According to the reporting, most states refused, and the administration has lost lawsuits seeking access to those files. The issue has become a major political flashpoint. The administration has argued that reviews are needed to protect election integrity. Critics point to studies showing noncitizen voting is extremely rare and has never decided a U.S. election. The DOJ also pursued election-related actions in California and Washington over ballots it alleged may have been linked to noncitizens. California rejected the administration’s push, and the U.S. Supreme Court declined an emergency request to set aside the ballots before Election Day. Should federal agencies be able to review state voter rolls after elections, or should that remain strictly in the hands of state election officials?
