@lawfullensjournal: Unsafe housing conditions can affect a tenant’s health, finances, and daily life. Should tenants have a clear legal right to leave without a penalty when landlords fail to address serious problems within a reasonable time? #Renters #Housing #TenantRights #Law #ViralQuestions
in some states I believe it legal to withhold payments until it gets fix

Not a question if landlord is in breach of contract. Pay attention to your rental agreements before you sign

I let my tenants leave whenever they want and they also get their last month free if they don’t leave all their stuff for me to deal with. All my Renters are long term at this point so must be doing something right.

Yes, i’m a landlord and I treat each one of my tenants like customers they pay for their service rent. I should give them that service that is needed. They pay for it.

Wouldn't the failure to make essential repairs constitute the breaking of a lease?

Yes they should be. I have big ass drywall wholes in my apartment mold growing every time it rains in my window. The whole window 🪟 is rotted out and they’re fix was to paint over it and say it’s gonna be fine

Robert Lee :
If there is a legal lease then the landlord would have already broken the lease by not fixing the problems, the one who breaks the least first carries the financial expense.

David Mclaughlin :
yes if repairs are needed they should be done and if the landlord doesn't have it done you can with hold rent and have the repairs done

It depends on how the lease is written out
If in the least, he says, I take care of all appliances, and those types of things, but your 16-year-old son gets mad and punches a couple holes in the wall. If that's not in the contract you need to be fixing that hole in the wall
So it really depends on what's in the contract.

I would. Let em try and take you to court! Depending on what kind of repairs, it should be an open and closed case. I have honestly been down that road once. We had giant rats. Land lord wouldn't do anything about it. So we neglected to pay rent! They evicted me for not paying! Oh was that an open close case!

As a former tenant association president, I would always suggest that you contact the courts. Put rent in escrow and let the judge do the rest
