Since today's hearing, I've discovered that Judge Fa'amomoi Masaniai has been the subject of significant misconduct findings in the past. Today, I believe he violated GR 16, which requires him to make a determination on the record and allow arguments from the media, the defense, and the prosecution. He refused to make a record or hear any arguments. The case against the suspect was ultimately dismissed. This makes the judge's actions even more puzzling, as the suspect was not going to be present in court. There was therefore no issue of the suspect's face being shown. This undermines the basic framework that keeps courts open to the public through media coverage. It also raises concerns about whether the judge intended to shield th proceedings from public view. This is concerning and warrants action by the presiding judge. It cannot simply be brushed aside.
