@seaturtleconservancy: Behind closed doors, a bipartisan group of Senators filed the Bipartisan American Affordability and Jobs Act at the end of September. Under the guise of “permitting reform,” within the language of this 417-page bill are concerning provisions that could gut the Endangered Species Act. Three aspects of the bill were taken from the ESA Amendments Act of 2025, the bad bill we helped defeat this year in April. The bill: 1) changes the definition of “best available science,” a bedrock principle under the ESA that informs how species are listed, 2) creates a program that could allow individual states to take over Section 7 consultations – a role currently held by the federal government, and 3) directs every biological opinion challenge to the D.C. Circuit, limiting the public’s access to local courts and overwhelming the D.C. Circuit. This bad bill will be voted on this Monday, November 9!
