NEW YORK MADE IT LAW. Under the Local Cops, Local Crimes Act, local police agencies can no longer maintain agreements that allow their officers to carry out federal CIVIL immigration enforcement duties. NO MORE DEPUTIZING LOCAL COPS THROUGH THOSE ICE PARTNERSHIPS. NO MORE USING LOCAL LAW ENFORCEMENT AS AN EXTENSION OF FEDERAL CIVIL IMMIGRATION OPERATIONS. And counties that refuse to comply? THE STATE IS WILLING TO TAKE THEM TO COURT. In fact, New York has already filed legal action against a sheriff’s office over an ICE cooperation agreement. BUT THERE’S MORE. On November 6, state officials reminded counties that agreements allowing local jails to house federal civil immigration detainees must end by NOVEMBER 25. NOW LET’S BE CLEAR. ICE has NOT been banned from New York. Federal agents can still enforce federal law. And police can still cooperate with federal authorities on criminal investigations. BUT NEW YORK IS REFUSING TO LET ITS LOCAL POLICE BE USED FOR ROUTINE FEDERAL CIVIL IMMIGRATION ENFORCEMENT. And that distinction matters. Supporters say local police should focus on local crime and community safety. Opponents argue the restrictions undermine cooperation between local and federal law enforcement. AND NOW THE LEGAL BATTLES ARE UNDERWAY. THE BIG QUESTION? Could New York’s approach influence how other states handle cooperation with ICE?
