TikTok Shop creators: REGISTER YOUR BEST CREATIVE FOR COPYRIGHT PROTECTION! ⚖️ Especially the videos that go viral, generate significant GMV, drive commissions, or attract the attention of brands that might want to use your content in their own advertising. Here’s why it matters. 👇 Your original creative generally receives copyright protection automatically when you create it. But registering your copyright with the U.S. Copyright Office, and doing so on time, can dramatically increase your leverage if a brand uses your content without authorization. Under federal copyright law, timely registration may allow you to pursue: 💰 Statutory damages of $750 to $30,000 per infringed work, without having to prove the precise amount of your financial losses. 💰 Up to $150,000 per work for willful infringement, if the legal requirements are satisfied. ⚖️ Recovery of reasonable attorney’s fees and costs, potentially shifting a significant portion of the expense of litigation to the infringer. And here’s why that changes the negotiating dynamic: Without access to statutory damages, you may have to establish your actual losses or the profits attributable to the infringement. That can be difficult, especially when a brand controls the advertising performance and sales data. With timely registration, the brand may face substantial statutory damages and potential liability for your attorney’s fees, even when your actual financial losses are difficult to quantify. That additional exposure can significantly improve your negotiating position when pursuing a settlement. ⏰ TIMING IS CRITICAL. For published works, registration generally must occur before infringement begins or within three months after first publication to preserve eligibility for statutory damages and attorney’s fees under 17 U.S.C. § 412, subject to the statute’s requirements and exceptions. Registering later can still provide important benefits, but it generally will not restore eligibility for those remedies for infringement that began before registration outside the statutory grace period. Your creative is intellectual property. Your best-performing videos are business assets. Protect them accordingly. If you’re a TikTok Shop creator producing valuable content, consider making copyright registration part of your regular business operations. And if a brand is already using your creative without permission, document the infringement and reach out to Draxton Law to discuss your options. ⚖️ LEGAL DISCLAIMER: Andrew Draxton is an attorney licensed to practice law in Utah.
