100% right! This is why I dont understand the "test" they do in hospital wards - 6 questions, whose the PM, the months of the year forwards and backwards. Not to mention not taking into account hard if hearing/language barriers etc.

when I was in hospital on my notes it said “no capacity” I was fed, meds shoved down my throat, dressed, showed, put back into bed, didn’t have access to my phone for a while but was aloud phone calls with my mum where apparently it would us both very distressed. what do you think about that although it different to community care without being detained under the mental health act. or when I was deemed to be financially abused in this prolonged episode and they would have to go through my phone or it would get taken away. I totally understand what your saying but in this situation when I was incoherent especially at periods; or unable to apparently do basic self care or not even swallow food properly. And like said different setting but do you think what they did was reasonable?

What if someone has a cognitive impairment eg learning difficulty . I have been told by a sw a mca isn’t needed for the client as they don’t want one. My worry is they are vulnerable to exploitation

Mental capacity is so complex like you say, and people often get it completely wrong. I am an ambulance care assistant and a couple of weeks ago was faced with having to judge whether a patient had the capacity to understand the risks. They had complete capacity and understood all the relevant risks to themself. I didn’t agree with their decision but obviously I respected their decision even though it went against my beliefs and I felt so bad. Despite the fact that I was respecting their decision, I took a little comfort when I saw them again a few days later.

Hubby had major stroke 2020 and lost speech. He can tell me name date of birth but other than that he can’t. They have since said he lacks capacity to remember anything and can’t make his own decisions

Navigating the process of social workers suggesting “no capacity “ is not easy for those who have “capacity”. I have totally lost heart in the system of geriatric care/ mental health/diagnoses and have come to the conclusion it is a way for tax paying elderly people to hand their hard earned saving to businesses ultimately out to make money in hand with the government.
