Refusing to unlock your smartphone could now lead to a prison sentence in Japan, even when prosecutors already have the device. A man in his 30s in Tokyo has become the first person indicted under Japan's electronic data order system, introduced in May. He was already facing an immigration-related charge for allegedly submitting false information in a foreign national's residence status application. Prosecutors seized his smartphone but could not access its contents without the password. A prosecutor then obtained a warrant from the Tokyo Summary Court ordering him to provide the phone's recorded data, potentially including messages, calls, and location information. He refused, prompting an additional charge. The penalty can reach one year in prison or a ¥3 million fine. In September, his lawyers argued before the Tokyo District Court that the order was invalid and that his refusal was protected by constitutional rights. Critics warn that compulsory phone access may violate protections against self-incrimination. Supporters emphasize that judicial authorization is required before such an order can be issued. Should Japanese authorities be allowed to punish someone for refusing to unlock their own smartphone, even with a court warrant?
