Don’s Knots :
In Canada, the right of survivorship on a joint account means the surviving account holder automatically gets full ownership of the funds, bypassing the deceased's will and avoiding probate, but this can be challenged, especially with adult children where courts presume a resulting trust (funds belong to the estate) unless the parent clearly intended a gift, requiring strong evidence beyond just signing a bank form. For spouses, it generally works seamlessly, but for parent-child accounts (often for convenience), the survivor must prove the parent intended a gift, not just a financial management tool, to avoid family disputes

Unless you are the Executor or one of them…then the ‘intention’ is usually from the onset of having made the account joint that it is part of the Estate.

Can you clarify: what if the executor is joint on the bank account. For example: mother’s account, daughter is executor and also joint with mother.
