Velasco, Jr. Two graduating students were barred from their commencement over photos their own Facebook friends showed a teacher. A schoolmate had uploaded the pictures. A computer teacher heard about them, and her students opened their own accounts on the school computers and showed her. The school found the photos broke six rules in its Student Handbook and kept the two out of the graduation rites. Their parents went to court for a writ of habeas data, the remedy for information someone else holds about you. They said the accounts were set to "Friends Only," which made the photos private and placed them beyond a school's reach. The school said nothing was taken from anyone: it was shown what people already entitled to see it chose to show. That left one question. Does a privacy setting on a social network mark off a space the law will protect? Vivares is where the Supreme Court worked out two things: whether that writ reaches a private school and not only the government, and how much a privacy setting on Facebook actually does. Later decisions weighing privacy in the digital age point back to it. 📖 Vivares and Sps. Margarita and Suzara v. St. Theresa's College, G.R.
