Here’s a simple explanation: ✅ Article 81 – Employee’s Right to Leave Without Notice Article 81 allows an employee to resign immediately without serving notice if the employer commits serious violations, such as: 🔹 Not paying salaries on time. 🔹 Physical or verbal abuse by the employer. 🔹 Forcing the employee to work in dangerous conditions. 🔹 Asking the employee to perform work that is different from the employment contract. 🔹 Any serious breach of the employment contract by the employer. If Article 81 applies, the employee may still be entitled to receive their legal benefits, including unpaid salary, end-of-service benefits, and other dues, provided they can prove their claim. ⸻ ✅ Article 77 – Compensation for Contract Termination Article 77 deals with compensation when an employment contract is terminated without a valid legal reason. Generally: ✔️ If the employer terminates the contract without a lawful reason, the employee may be entitled to compensation. ✔️ If the employee ends the contract without a valid legal reason, the employer may also have the right to claim compensation, depending on the circumstances. For unlimited contracts, compensation is generally based on 15 days’ wages for each year of service, with a minimum of two months’ wages, unless the employment contract specifies otherwise. Fixed-term contracts may have different compensation rules depending on the remaining contract period and contract terms. ⸻ 📌 What’s the Difference? ✅ Article 81 protects employees when the employer violates the law or employment contract. ✅ Article 77 explains compensation rules when an employment contract is terminated without a valid legal reason. ⚠️ Important: Every case is different. Whether Article 81 or Article 77 applies depends on the facts, evidence, the employment contract, and Saudi Labour Law. If a dispute arises, the final decision is made by the relevant Saudi labour authorities or labour court.
