@calmmoneycoach: Mom puts you on her account for "convenience." She dies. You think the account is yours. Your siblings hire a lawyer. Your siblings win. The case is Pecore v. Pecore, 2007 SCC. The default flipped and most families have no idea. If you're a parent, document your intention now. If you're an adult child on a parent's account, have the conversation. Better at the kitchen table than the lawyer's office. And if the family situation is complicated, you can hire it out. Trust company, estate firm, agent for executor. That's where they earn their money. Full workbook in the Calm Money Community. calmmoneycoach.ca Reply with any questions, I read everything.

Clarification please on the statement that a joint account saves probate fees. My name was on my mom’s acct. My brother and I, as her executors and 50/50 beneficiaries are in total agreement that, after taxes and expenses, the remainder will be split between us. But will her estate NOT have to pay probate fees on the amount in the account at the time of her death?

It ticks me off that the bank - which is in the perfect position to set out the intentions of the parent - doesn’t get the information when the account is made joint.

What if my mother and I have a joint account and we have both been making deposits to the account. But over the years we have no clue who put in how much?

My brother has no idea my joint account with my mom exists. She has written s letter saying it's a gift. So hopefully I don't have to deal with this

I have a couple yrs old letter from a lawyer and one currently from a doc saying my dad can make decisions about his finances. Is that enough to be his only beneficiary? He has given them money already and has a little left over.

Agree with everything and would add just one more point…let your lawyer know your intentions on the joint account. A competent lawyer puts a memo to file which can later be used in court to ascertain intent.

It always goes to the estate and follows the will. That’s what an executor takes care of.

We added all 3 siblings names on the accounts, it made it so simple. We all had online access, when the time came we simply transferred our share to our individual accounts. No probate, no bank involvement. Then closed all the accounts.

My grown daughter is my executor so I’m forwarding these videos to her but I learned something major here. I’ve put both my daughters on my bank accounts so they can have access to my money immediately. My RRIF & LIF has them as beneficiaries. Did I do something wrong? This is laid out in my will.
