Gender and sex are ontologically the same thing because gender is the objective referent to sex and likewise. If gender has no objective referent (not sex) then it becomes completely arbitrary gender exists because of sex. Gender is just the epistemological ontology of sex with the objective referent of sex. To say gender is a social construct is to say gender is an epistemology with out an ontology how does that work¿

Gender is cosplay and has no power or standing in matters of the law. Thus, a man cosplaying as a woman via the aping of superficial characteristics is in no actual or legal way a woman, and therefore cannot function as a woman in a sociocultural sense (participate in women’s sports or enter into women’s spaces). Also, academics can decide among themselves that female and woman are not synonyms but that agreement also has no legal standing. A woman is an adult human female.
