@kirafonteneau: Most employees know it is illegal for an employer to retaliate against them for taking FMLA leave. What many people do not know is that retaliation is only half the story. Employers can also violate the law by discouraging you from taking leave in the first place. If your manager pressures you not to take leave, suggests your career will suffer if you do, fails to tell you that you may qualify for FMLA protection, or incorrectly calculates your leave time, those actions may be considered FMLA interference. You do not have to wait until you are fired to have a legal issue. If you believe you may qualify for FMLA leave, make your request in writing and keep copies of everything. Save emails, document conversations, and record any comments suggesting your leave is unwelcome. The paper trail you create today may become the evidence you need tomorrow. Our company tries to break the law all the time and I called them out on their new policy. They told us we have to give a two hour window if we’re calling in or leaving work. I told them I have a medical condition and I can’t give them that and they would take my point away every time they did not announce it to the rest of the company though. I told them they are breaking the law, but they already knew that.

It happened to me and they pressed me to come back to work, I have text messages from them and they demoted me the day I came back to work they gave me a proposal of removal on me.
