Applying for a green card? The public charge rules changed on September 18, 2026 — and benefits that previously fell outside the analysis may now receive much more scrutiny. Under the new rule, immigration officers have broader discretion to look at means-tested public benefits and your overall financial circumstances when deciding whether you’re likely to become a public charge. That does NOT mean receiving Medicaid, SNAP, housing assistance, or another benefit automatically gets your green card denied. Public charge is still evaluated based on the totality of your circumstances. Your filing date matters. Your immigration category matters. And some applicants — including certain refugees, asylees, VAWA self-petitioners, and U- and T-visa applicants — may be exempt from the public charge ground altogether. Most importantly: don’t cancel benefits based on a TikTok video.
