@cbsnews: Video appears to show a worker tossing a 23-month-old child over her head and failing to catch him at the Bay Club in El Segundo, California, in March of 2025. According to the lawsuit filed by Rosen Saba, LLP, the law firm representing the toddler’s parents, the child suffered a traumatic brain injury and hearing loss after the employee failed to catch him. The family is suing the club for negligence, battery, fraud and emotional distress. The lawsuit claims the club misrepresented the circumstances of the incident when notifying the family of their child’s fall. “The deception by the Bay Club of hiding this horrific incident from the parents is inexcusable. The day care facility should have the highest amount of care for the children, and if a child gets sick or injured, they should notify the parents with transparency and urgency,” Ryan Saba of Rosen Saba, LLP said. A spokesperson for The Bay Club shared a statement with CBS LA upon request. It said, "We are unable to comment on ongoing litigation. At the Bay Club, the safety of our members, team members, and the families we serve is our highest priority."
