I am confused - I am from the UK so might be different. So as I understand her contracted hours are 40. From that she had a day holiday in that week? So then she was due to work 32 hours that week. But she worked an additional 11 hours to bring her total working hours to 43. So I agree her holiday should not be paid as OT, but I disagree and believe she did work 11 hours OT. Over here we probably would have just let her have three days off instead of using her holiday? As she had worked her contracted hours? I don’t understand why the holiday hours aren’t taken from her contracted hours? Holiday is part of the package and effectively she just shouldn’t have bothered taking the day holiday if she wasn’t getting paid the overtime? If you’re only paying her 3 hours of overtime, then you should give her a days holiday back.

I still don't get it. if the work week is 5 days, and you work 8h a day, then if Friday is a holiday, she should have worked 32 hours that week. She obviously doesn't get paid for those 8h she didn't work, but if she really worked 43 hours from Monday to Thursday, then she did work 11h overtime, because 43-32=11h. If she did work Friday, she's actually work 51h in the week, so that would still be 11h of OT, because 51-40=11. Or is that not how it works in the US?

Genuine question though, why isn’t the ordinary working week 32 hours when the building is closed as opposed to 40 hours with a 8 hour credit? Because i think this is what she’s objecting to. She worked an additional 11 hours over what she was expected to and i appreciate that you have decided to differentiate between plain time and overtime but those 11 hours were antisocial hours and optional which would ordinarily attract the overtime status. She wasn’t in control of working that day.

While I understand where she’s coming from and while I UNDERSTAND it is incredibly frustrating and an unfair system… a full max work week is 40 hours within 7 days. How you spread that out is irrelevant in most states (aka 4/10s, 5/8s… etc). She worked 43 hours and that led to 3 hours of OT (paid at time and a half). Most places don’t pay holiday so the extra 8 hours being paid for NOT working is a major bonus and shouldn’t be expected to be paid at time and a half.

This is so crazy. Holiday hours are not working hours. No company ever has given time and a half or double time for hours you didn't even have to show up for. To complain about basically free money is outrageous.

That seems to be an American thing. In the countries I worked, there would be a set hours per week and the remaining is overtime. If she had 8hrs holiday, 32hrs work to get to 40 and then the remaining 8+3=11 would all attract overtime. Using the logic in the video as soon as you have 1 day off in a week be it sick, PTO or holiday you’d effectively be punished for going above 40hrs in that week. Make it make sense, why would your hour suddenly be worth less just because you had a different pay bucket day in That week already..

I get where she's coming from. If she hadn't worked any overtime, the 8 hours for the holiday would count towards the 40 hours she's contracted for per week. However, she totaled 51 hours for this week, of which 8 hours are due to a holiday. I would also consider the 11 hours overtime.

This is so different from what I typically see in my country. Here, the 8 hours of holiday (whether Annual Leave / PTO or Public Holiday) would usually count towards the base 40 hours because they are legislative entitlements. So odd to hear the States don't typically do this. Of course, the States seems to have very limited leave entitlements by comparison to our country, so I shouldn't be surprised. 😂

In our system, the paid holiday counts as part of the 40 hour workweek. So if Monday is a paid holiday (8 hours), I'm expected to work 32 hours the rest of the week. Anything over 32 hours is paid as overtime.

My company does lower the worked hours requirement during a holiday week so that anything in excess of the typically scheduled hours counts as overtime. I’m in the US. There are companies out there like this. I would have been confused too.
