Main Details of the New Ja'fari Personal Status Law The law includes currently married couples and those married previously, and it applies to them under the new Ja'fari Personal Status Law. This means that the law includes previous and current marriages. Marital guardianship for the father: A girl may not leave her father's obedience under any circumstances, regardless of her age, and she does not lose custody of her father unless she marries, in which case guardianship transfers to the husband. Custody of the child is granted to the mother if she is divorced until the child reaches seven years of age. If the child is under seven, custody belongs to the mother; after seven years, custody belongs to the father. The husband has the right, in the event of divorce, to submit a request to the judge to convert his personal status to the Ja'fari school, even if the wife objects; the request is not rejected on that basis. The husband has the right to convert to the Ja'fari personal status provisions upon his own request. If the wife stays at her family's home for any reason (such as anger or an argument), she loses custody and financial support in full, and she must notify the Sharia judge, then return to her husband or divorce. The mother loses custody of her children regardless of their age if she marries after her divorce and the child is two years old or older; custody then passes directly to the father. The rights that the wife acquired under the old law, including financial rights and the right to housing and other continuing benefits, are forfeited; these rights are considered null under the new law. If a wife has been outside her husband's obedience for seven years instead of the two years stipulated in the previous law. A woman will be deprived of the protection afforded to the Iraqi family regarding marital matters, as a law will be enacted that prohibits her from speaking about her future. A husband has the right to marry a second woman without the first wife's consent.
