Erik and Lyle Menendez are hoping to get parole 35 years after their conviction for the 1989 murders of their parents. A judge denied Los Angeles County District Attorney Nathan Hochman’s last-minute attempt to delay today's resentencing hearing, calling it a “Hail Mary.” In a late Wednesday filing, prosecutors requested a risk assessment of the brothers, conducted by the California Board of Parole Hearings at the request of Governor Gavin Newsom. They also asked the court to postpone the hearing until the report could be retained and reviewed. That didn't happen. That delayed the resentencing hearing by a few hours. It will likely last two days. 10 family members are expected to take the stand, along with a prison expert and former inmate. Menendez family attorney, Mark Geragos, has questioned Hochman's repeated tries to keep this hearing from happening. He says these actions have pushed him to consider filing a motion to have Hochman recused in the case.
