Why are some states and school districts adding a question to the IEP process asking parents, “Has anyone discouraged you from bringing someone to this meeting?” I have seen firsthand how some parents are discouraged from bringing an advocate, attorney, or another support person to an IEP meeting. Sometimes the discouragement is direct. Other times, it is much more subtle. Parents are told things like: “You don’t need an advocate. We’re all on the same team.” “Bringing an advocate will only make the meeting more difficult.” “We would prefer to work directly with you.” “Why are you bringing someone? Don’t you trust us?” Some parents are even made to feel that bringing an advocate is confrontational or that it will damage their relationship with the school. This is exactly why asking about discouragement matters. Under federal law, parents have the right to include individuals who have knowledge or special expertise regarding their child as members of the IEP team. Parents should never feel pressured to attend an IEP meeting alone, especially when they are navigating complicated evaluations, placement decisions, behavioral concerns, or disagreements about services. An advocate is not automatically an adversary. An advocate can help parents understand the process, ask informed questions, review documentation, and meaningfully participate in decisions about their child’s education. And let’s remember something important. A parent bringing an advocate does not create a problem. Often, the problems already existed before the advocate was contacted. Parental participation is a protected right, not a privilege granted by the school district. #sped #fape #specialeducation #iep #504plan
